DMK MP P. Wilson claims 144 votes for TVK in confidence motion are legally incorrect, citing potential disqualifications under anti-defection law.

P. Wilson, a Member of Parliament representing the Dravida Munnetra Kazhagam (DMK) and a senior advocate, has raised legal concerns regarding the voting outcome of the recent confidence motion in the Tamil Nadu Assembly. Wilson argues that the reported total of 144 votes secured by Chief Minister C. Joseph Vijay's party, the Tamilaga Vettri Kazhagam (TVK), could face legal challenges.

According to Wilson, if the 25 rebel members of the All India Anna Dravida Munnetra Kazhagam (AIADMK) and a solitary rebel from the Amma Makkal Munnetra Kazhagam (AMMK) are disqualified under the anti-defection law, the total votes that can be counted for the TVK would be 118.

He pointed out that Edappadi K. Palaniswami, the general secretary of the AIADMK, had directed party members to oppose the motion, which can be interpreted as a directive under Clause 2(b) of the Tenth Schedule of the Indian Constitution. Furthermore, Wilson accused TTV Dhinakaran, the solitary MLA from AMMK, of being coerced into supporting the government through alleged monetary incentives.

Wilson expressed concern over the Speaker of the Assembly allowing the dissenting AIADMK faction, led by Mr. Velumani, to cast their votes in favour of the TVK, questioning the legality of this action as a potential violation of the Tamil Nadu Legislative Assembly (TNLA) Rules.

Legal experts are suggesting that if these procedural irregularities are challenged, the 26 votes in question could be ruled invalid by either the state Governor or the courts. Wilson also indicated that the Speaker might have opted to form an investigative committee to look into the 'cash-for-votes' allegations, a practice endorsed by the Supreme Court in the Raja Ram Pal case.

Despite these issues, Wilson acknowledged that, with the support of his party and allied Congress members, the TVK would still have managed to secure a majority with 118 votes, thereby preventing the imposition of President’s rule in Tamil Nadu.
