Scottish Sikh Man Receives Bail in India After Nine-Year Detention

Jagtar Singh Johal, a 39-year-old Sikh activist from Scotland, has been granted bail by a Delhi court after being detained in India since 2017 on allegations of terrorism offences. Johal's arrest occurred shortly after he arrived in Punjab to marry his fiancée. His family described the lengthy legal process, which has been marked by delayed hearings and a lack of substantial evidence, as an 'expensive rollercoaster.'

Johal was accused of funding the Khalistan Liberation Force, a group linked to targeted killings in Punjab, but his lawyers have consistently argued that the prosecution has failed to provide credible evidence against him. A court in Punjab dismissed similar conspiracy charges last year, leading to scrutiny of the Indian authorities’ handling of his case.

Johal's brother, Gurpreet Singh Johal, expressed relief and happiness at the bail ruling, stating, “We have waited so long and fought so hard for this moment.” He raised concerns about the nature of the legal process, questioning, “How long will this sick joke of a legal process be allowed to continue?” The family has been actively lobbying UK officials for support throughout this protracted ordeal.

Conditions attached to Johal's bail include surrendering his passport and restrictions on media communication. He is required to pay a personal bond of 500,000 rupees, equivalent to approximately £3,907, and is limited to using one phone. Despite the bail ruling, Johal still faces serious charges from federal authorities, including the death penalty for what advocates describe as politically motivated allegations.

Support groups including Reprieve and Redress have welcomed the court’s decision but highlighted that Johal has endured significant suffering during his unjust detention. Dan Dolan, deputy executive director of Reprieve, noted the necessity of overseeing the implementation of the bail order while expressing doubts about the legal proceedings he continues to face.

Chris Esdaile, a senior legal advisor to Redress, reaffirmed the urgency for accountability regarding allegations of torture during Johal's detention and described his situation as still precarious.

Johal’s detention has been labelled arbitrary by a panel from the United Nations, citing concerns over conditions and his treatment. His case has drawn widespread attention from human rights advocates and has emphasized challenges faced by Sikh activists in India. As authorities prepare to finalise the details of his bail, Johal’s family and supporters are cautiously optimistic about his future and the possibility of his return to Scotland.
