New Visa Fee Increase Announced for Select US Work Visas

Beginning on 9 September 2023, employers seeking H-1B and L-1 visas in the United States will be subject to increased application costs due to a recent rule implemented by federal authorities. This fee adjustment is designed to bolster funding for various immigration initiatives and is expected to significantly impact businesses reliant on foreign labour.

The H-1B visa programme allows US companies to temporarily employ foreign workers in specialty occupations, while the L-1 visa facilitates the transfer of employees from foreign branches of companies to their US offices. Both visa categories are integral to the US job market, especially in sectors such as technology, engineering, and healthcare.

Under the new regulation, the application cost for H-1B visas will increase from $460 to $1,610 for most employers. Meanwhile, for L-1 visa applications, the fee will rise from $960 to $1,815. These changes mark a substantial financial burden for companies that rely on these visas to address skill shortages and promote diversity in the workplace.

According to a statement from US Citizenship and Immigration Services (USCIS), the additional funds generated by these increased fees will support various immigration programmes and services, including asylum processing and refugee resettlement. "The funds will help ensure that we can continue to process applications and petitions efficiently and effectively," a USCIS spokesperson remarked.

Experts argue that while increased fees may serve to enhance immigration services, they could also deter businesses from employing foreign talent. Small to medium-sized enterprises (SMEs), which often lack the financial resources of larger corporations, may be especially hard hit.

Business leaders have expressed concern about the implications of the fee hikes. Some foresee a possible downturn in recruitment from international markets, which could exacerbate skill gaps in certain industries. As such, there are calls for a reassessment of the fee structure to maintain the competitiveness of the US economy.
