Jamiat Leader Criticises Supreme Court, Sparks Controversy in India
Maulana Mahmood Madani's remarks on the Indian Supreme Court draw sharp reactions, highlighting concerns over minority rights and judicial independence.

Maulana Mahmood Madani, the president of Jamiat Ulama-i-Hind, has stirred controversy with his recent remarks regarding the Indian Supreme Court, suggesting that the court is under undue government influence and does not merit the title of 'supreme'.

Speaking at the National Governing Body meeting of Jamiat Ulama-i-Hind in Bhopal, Madani expressed significant concerns about the safety of the Muslim community in India. He stated, "After the verdict on the Babri Masjid, triple talaq, and several other cases, it seems that courts have been functioning under government pressure for a few years now. The Supreme Court can only be called supreme if it adheres to the Constitution and upholds the law. If it fails to do so, it does not deserve that title."

Madani's comments specifically referenced ongoing legal matters including the Gyanvapi Mosque and Mathura cases, accusing the court of sidelining the Places of Worship Act, which aims to maintain the religious status of places of worship as they stood on August 15, 1947.

Additionally, he highlighted the emotional toll on Muslims, citing derogatory terms such as 'love jihad', 'land jihad', 'education jihad', and 'spit jihad', which he claims are used to demean the Muslim faith. The Jamiat leader remarked, "The current situation in the country is very sensitive and concerning. A particular community is being targeted, while others are left powerless, socially segregated, and economically humiliated. The ongoing actions against religious properties and the negative portrayal of educational institutions have instilled fear in the community."

In response, Sambit Patra, a spokesperson for the Bharatiya Janata Party (BJP), defended the integrity of the Supreme Court, asserting that it operates independently of religious considerations. He suggested that Madani's remarks warrant judicial scrutiny, stating, "The Supreme Court does not base its judgments on religion. It is imperative that the court takes suo motu cognisance of these comments."

Madani's remarks follow a previous controversy involving Jamiat Ulama-i-Hind's Maulana Arshad Madani, who had raised concerns about discrimination against Muslims in educational settings, particularly referencing Al Falah University amidst the backdrop of a probe related to a recent Delhi blast.

Madani pointed out the global context, contrasting the political representation of Muslims abroad with that in India. He stated, "While figures like Zohran Mamdani can become the mayor of New York and a Khan can achieve similar status in London, Muslims in India struggle to secure positions like vice-chancellorships in universities."

He further stated, "The world perceives Muslims as being oppressed and powerless. However, I believe that this is not the case. The government appears to be working tirelessly to ensure that Muslims do not assert themselves."

BJP leaders have condemned Madani's comments, accusing him of politicising the issue and attempting to create communal discord. Yaser Jilani, a spokesperson for the Delhi BJP, remarked, "Madani's statements are a threat to national integrity. He is trying to disturb communal harmony in India."

The ongoing discourse surrounding Madani's remarks has ignited debates about the state of minority rights, judicial independence, and the political landscape in India. As the situation evolves, reactions from various sectors of society continue to emerge, reflecting the deep divisions and complexities within Indian politics today.
