A BBC investigation has uncovered a troubling trend where migrants are allegedly fabricating claims of domestic abuse to secure residency in the United Kingdom. These individuals are reportedly taking advantage of rules designed to assist genuine victims, enabling them to gain permanent residency more swiftly compared to alternatives, such as applying for asylum.

The investigation highlighted that ineffective checks by the Home Office are allowing these claims to be made with little evidence. As a result, British partners affected by these allegations have been faced with significant upheaval in their lives. Legal professionals have expressed concerns over the potential for exploitation within the existing legal framework known as the Migrant Victims of Domestic Abuse Concession.

This concession was established to provide support for migrants on temporary visas who can demonstrate they are victims of domestic abuse. Reports indicate that the number of individuals claiming fast-track residency on this basis has surged to over 5,500 annually, reflecting a rise of more than 50% over the past three years.

In a specific case documented by the BBC, a British mother who had reported her partner for rape was later falsely accused of domestic abuse by him. This unfounded allegation was reportedly made to prevent his deportation to Pakistan.

An undercover reporter engaged with a young immigration adviser named Eli Ciswaka in London, who appeared willing to assist in fabricating a domestic abuse claim for a fee of £900. During their interaction, Ciswaka suggested that the reporter pose as a victim of domestic abuse, leveraging emotional manipulation as a basis for the claim.

Ciswaka, whose firm operates under the name Corporate Immigration UK, frequently promotes the domestic abuse concession on social media, showcasing various successes in helping clients navigate this route.

Experts and lawyers have voiced their concerns regarding the accelerated process for obtaining residency under the domestic abuse category. They warn that the expedited nature of these claims, especially when linked with a need for immediate support, opens the door for manipulation.

Under existing Home Office protocols, migrants who report domestic abuse while holding temporary visas can apply for a special concession permitting them to stay in the UK for three months and access financial assistance. Once granted this status, they can apply for indefinite leave to remain in the UK. In contrast, other pathways to permanent residency often entail waiting periods of several years.

The investigation underscored serious flaws in the way the Home Office interacts with unregulated immigration advisers. During the interview, Ciswaka showcased a letter from the Home Office confirming a successful application for a previous client, although it remains unclear if that case was based on genuine abuse.

Despite being an unregistered adviser, Ciswaka detailed how he would create a narrative for the Home Office, including classifying non-violent arguments as 'psychological domestic abuse'. He reassured the reporter that he had a track record of success, claiming that all previous applications he had submitted had been accepted.

Legal analysts stress the importance of reforming these policies to protect real victims of domestic abuse while safeguarding against those looking to manipulate the system for personal gain.
