Election Commission Restricts TMC Use of Name and Symbol in Bypolls

The Election Commission of India (ECI) has implemented an interim order restricting both factions of the Trinamool Congress (TMC) from using the party's name and its traditional 'Flowers & Grass' symbol in the forthcoming by-elections in West Bengal. This ruling comes as a response to an ongoing dispute between rival groups within the party that have both claimed authority over its identity.

The by-elections for the Nandigram and Rejinagar Assembly constituencies are scheduled for October 6. In light of the divisions, the ECI has mandated that both factions, one led by former West Bengal Chief Minister Mamata Banerjee and the other by Arup Roy, select distinct names and symbols for their respective candidates.

In its order, the Commission has prohibited the use of the official name 'All India Trinamool Congress' and the associated symbol. Each faction has been directed to submit three name preferences for their new identities by 11 am on September 18. Additionally, they must propose three alternate symbols from a list provided by the ECI.

The commission's decision was influenced by its evaluation of competing claims from both factions, which have been looking to establish their legitimacy as representatives of the recognised political party. Hearing commenced earlier this month, with documentation submitted to support each side's claims. However, given the rapidly approaching election date, the ECI opted for a provisional ruling to ensure both groups can compete fairly.

This interim arrangement will remain in effect until the Commission reaches a final conclusion as stipulated under the Election Symbols (Reservation and Allotment) Order of 1968.

The announcement has elicited mixed responses from the factions. Supporters of Mamata Banerjee have dismissed the order as 'contrary to law,' expressing intent to challenge its validity. TMC Member of Parliament Kalyan Banerjee noted, 'This order is contrary to law. We are not accepting it as there are so many legal infirmities.' He indicated that the group would advise the ECI of their next steps by the deadline set.

Conversely, the faction loyal to Arup Roy welcomed the Commission's intervention. TMC MLA Akhruzzaman Ansari, representing the rebel camp, stated they would comply with the interim order and expressed optimism about ultimately regaining the original party designation and symbol. 'Obviously, we wanted the twin-flower-on-grass symbol, but the EC has given an interim order. We are confident that when the EC delivers its final verdict, we will reclaim our official name and symbol,' he commented.

As the situation unfolds, it remains to be seen how the factions will adapt to the requirements set forth by the ECI in the lead-up to the bypolls. The decision illustrates the ongoing turbulence within the TMC and the implications for its future in West Bengal's political landscape.
