Election Commission Responds to Allegations of Internal Disputes

The Election Commission of India (ECI) has faced scrutiny following an investigation by The Indian Express, revealing that two of its three Commissioners expressed formal objections on at least 14 occasions regarding various decisions made without their involvement over the last ten months.

Chief Election Commissioner Gyanesh Kumar attended an event at Colvin Taluqdars' College in Lucknow, where these concerns were raised prominently. The ECI's response, however, has been viewed as an attempt to sidestep the gravity of the issues presented, particularly concerning the deletion of 130 million names as part of its special intensive revision of voter rolls.

The investigation detailed that both Sukhbir Singh Sandhu and Vivek Joshi disagreed with certain decisions made during the implementation of the Special Intensive Revision (SIR) by the ECI. There are significant implications for the legitimacy of this process, as noted by reports from The Indian Express. While the ECI's press release emphasised its constitutional mandate under Article 324 of the Indian Constitution and affirmed that all its actions comply with laws and established procedures, many remain unconvinced.

According to the ECI's statement, it operates as a multi-member body and practices transparency, stating that "written notes, observations, technical suggestions and internal checks-and-balances are standard, ongoing practices." However, the election body’s assurance of legal compliance seems weakened against allegations that two Commissioners felt sidelined in decision-making regarding voter registrations and deletions.

The ECI downplayed the significance of these objections, framing them as part of standard administrative practices aimed at enhancing electoral processes. In its statement, the ECI mentioned that differing opinions among its members are a normal aspect of the deliberation process.

Nevertheless, the criticisms by Sandhu and Joshi were not merely suggestions but formal complaints, with Sandhu specifically stating that certain actions of the Commission were "unauthorised and illegal." Both Commissioners reportedly raised concerns regarding the integrity of voter software and the implications of a centralised database that bypasses state officials.

The ECI countered accusations of mismanagement by highlighting its recent successes in conducting major elections in states such as Bihar, Kerala, and West Bengal, asserting that these activities involved substantial administrative efforts and strict approvals from the Commission. However, the issue of contentious deletions, particularly in West Bengal, raises questions regarding the ECI’s understanding of the broader impact these changes have had.

Responding to concerns about digital security and database management, the ECI claimed that its systems are fortified with strict data security protocols to preclude unauthorised interference. It stated that the statutory framework guiding electoral changes is robust and within legal bounds.

The situation remains fluid as court hearings regarding the deletions in West Bengal proceed, and questions continue to arise about the ECI's commitment to transparency and electoral integrity. The ECI concluded its press note with a commitment to fulfilling its constitutional responsibilities with integrity, affirming its critical role in sustaining the democratic process.
