Court Allows Seven Foreign Nationals to Return Home in Drone Case

In a significant legal development, a Delhi court has granted permission for seven foreign nationals to return to their home countries for one month. This group includes Matthew Aaron Van Dyke, an alleged American mercenary, and six Ukrainians, who had been detained in connection with an investigation into a drone-warfare training camp related to ethnic armed groups in Myanmar.

The decision, made by Special Judge Prashant Sharma, came as these individuals were released from Tihar Jail after completing necessary legal formalities. The court stated that the right to travel abroad aligns with the fundamental rights outlined in Article 21 of the Indian Constitution. The ruling emphasised the need to balance individual rights against any ongoing investigations.

The Ukrainian nationals had been discharged from their detention on September 18, while Van Dyke’s release occurred on September 25. The court highlighted that these individuals were subjected to fines of Rs 5.5 lakh each, imposed by the Foreigners Regional Registration Office (FRRO).

Previously, the National Investigation Agency (NIA) had filed its first chargesheet on September 8, which did not invoke the provisions of the Unlawful Activities (Prevention) Act (UAPA). The NIA's ongoing investigation encompasses allegations of conspiracy under Section 18 of the UAPA as well as various provisions under the Bharatiya Nyaya Sanhita (BNS).

Despite the admission of guilt being compounded by the FRRO, the NIA has stated that it continues to investigate potential UAPA violations, with the possibility of submitting a supplementary chargesheet should further evidence be obtained.

Reports indicate that a substantial portion of the ongoing UAPA investigation has been concluded, yet the agency has requested additional time to clarify all circumstances surrounding the case, particularly concerning import and registration aspects. The implications of this case remain significant as the NIA continues to scrutinize potential links to terrorist activities in the region.
