Essel Group Chairman Subhash Chandra Assures Lenders on Debt Repayment

Subhash Chandra, chairman of Essel Group, has provided reassurance to lenders about the ongoing reconciliation of outstanding debts from various entities associated with the group. In a statement regarding his financial status, Chandra announced that he holds no personal debt and supports his guarantees with ₹22,000 crore.

The repayment plan, as outlined by Chandra, includes a commitment of ₹6.25 crore from his own resources, with additional contributions amounting to ₹1,494 crore from other group entities. While Chandra claimed that most of the owed amounts had been settled, certain lenders are contesting the repayment plan approved by the National Company Law Tribunal (NCLT) and are exploring options to appeal the decision.

Several creditors have voiced their concerns, highlighting a significant discrepancy between their claims and the amount included in the repayment scheme. According to court documents, the plan allocates only ₹6.25 crore for creditors against total claims nearing ₹22,006.57 crore. This substantial gap has raised questions about the effectiveness of the Insolvency and Bankruptcy Code (IBC) in facilitating appropriate recoveries.

Despite the assurances provided by Chandra, the situation remains contentious, as some lenders, including those represented by Solicitor General Tushar Mehta, are pushing back against the NCLT's judgement. They argue that allowing the plan to proceed as approved undermines the intent of the IBC, which seeks to maximise creditor recoveries in insolvency cases.

The upcoming hearings in the National Company Law Appellate Tribunal (NCLAT) may shed further light on the complexities of this case, especially as challenges from creditors continue.

Sources indicate that multiple creditors are united in their dissatisfaction with the NCLT's ruling and have expressed their intent to challenge the legitimacy of the approved repayment strategy, as they seek to secure larger recoveries from Chandra and his affiliated businesses.
