Australia's Foreign Minister criticises Israel's decision not to pursue a criminal investigation into the death of an aid worker in Gaza.

Australia's Foreign Minister Penny Wong expressed strong outrage following Israel's military decision not to conduct a criminal investigation into the killing of Zomi Frankcom, an Australian aid worker shot in an air strike in Gaza. Frankcom, along with six colleagues, lost her life in an Israeli attack in April 2024.

In a formal statement, Wong remarked that the decision "falls far short of the accountability we expect". The Minister summoned Hillel Newman, the Israeli ambassador to Australia, to discuss the matter further. After their meeting, Ambassador Newman defended the actions of the Israel Defense Forces (IDF), asserting that there was no intent to commit a crime and therefore no grounds for criminal responsibility.

Zomi Frankcom's family, in a statement released on Thursday, expressed their deep disappointment regarding the IDF's conclusion. They reiterated their belief that an independent investigation is necessary. They stated, "As a family, we do not believe this to be accurate and we continue to call for an independent investigation." Among the victims of the April attack were three British nationals, a Palestinian individual, a Polish national, and a dual US-Canadian citizen.

The UK government has not yet issued a statement regarding Israel's decision. Wong mentioned that there remain many unresolved issues, including the sequence of events that led to multiple strikes on the aid convoy. She questioned why, after the initial air strike, two additional strikes occurred within minutes. Furthermore, she deemed the removal of two officers from their posts and the reprimanding of three other officers as "insufficient accountability" for a tragedy that took seven lives.

The Australian government has requested drone audio from the incident, which has yet to be provided. In its statement regarding the case, the IDF claimed that the presence of an armed guard with the convoy had not been communicated beforehand and alleged that he was mistakenly identified as a Hamas fighter. The IDF also indicated that the convoy had deviated from its coordinated route.

Despite acknowledging "serious failures" that led to the killings, the IDF concluded that actions taken by military commanders did not raise reasonable suspicion of criminal misconduct.

On the same day, the IDF stated that it found no basis for criminal investigation into the killing of four Médecins Sans Frontières (MSF) workers during two separate incidents in November 2023 and February 2024. Wong described Israel’s decision as particularly hurtful since it coincided with World Humanitarian Day. She noted, "This decision falls far short of the accountability we expect from Israel, given the admissions made by the IDF regarding misidentifications and procedural failures."

World Central Kitchen (WCK), the organisation for which Frankcom worked, labelled the IDF's findings as "inconsistent with the full truth" and condemned the investigation as an internal review that cannot adequately address the outcomes. The organisation insisted on an independent inquiry, arguing that the IDF cannot impartially assess its own actions.

Wong’s remarks are among the strongest criticisms levied at the Israeli military by the Australian government since the onset of the recent conflict, reflecting a broader wave of international condemnation regarding the attack on the aid convoy.

Ambassador Newman reiterated that there was no intent to harm innocent individuals, expressing regret for the families affected. However, he declined to offer any apologies, citing potential legal consequences.

In addition to these events, it was reported that former Australian Defence Force Chief Mark Binskin mentioned in a recent report that significant failures within the IDF procedures directly contributed to the deaths of Frankcom and her colleagues. The IDF had previously acknowledged the incident as a “grave mistake.”

In contrast to the decision regarding Frankcom, the IDF announced a criminal investigation into the killing of a five-year-old Palestinian girl and six of her family members. An ambulance sent to assist them had also come under fire, resulting in the deaths of two paramedics.

The retention of accountability in military actions continues to be a focal point of concern for international observers, with various stakeholders advocating for independent investigations into such incidents. Amid ongoing conflicts, the call for sufficient oversight and advocacy for civilian safety remains pressing.
